ARTICLE 1 – SCOPE AND ENFORCEABILITY

1.1 These general terms and conditions of sale (hereinafter the “GTCS”) apply in their entirety and constitute the conditions of all offers and sales by bohodresses.store (hereinafter the “Products”), offered by the company EcomShop (hereinafter the “Seller” or “us”), to any consumer customer, adult at the date of purchase on the site or minor, emancipated or proving an authorization signed by his legal representative, residing in metropolitan France (hereinafter the “Customer” or “you”), on the site bohodresses.store

(hereinafter the “Site”).

 1.3. You may consult the GTC at any time on the Site by clicking on the “GTC” tab at the bottom of the Site’s home page. The applicable GTC are those in force at the time of your order on the Site.

ARTICLE 2 – ORDERING PRODUCTS

2.1 Creating a Customer account

To order Products on the Site, you must have a Customer account. To do this, you can complete the form available in the “Create an account” area of the Site, fill in the fields marked with an asterisk and click on “Create a new account”.

In particular, you need to enter the username of your choice (provided it is not already being used by another customer) and the password of your choice.                                                                                                                                                       

Once you have completed your registration, you will receive a confirmation e-mail containing a link to activate your account, which you must click to finalise your registration.

You undertake to provide accurate and up-to-date information about your identity and address and to update it in the event of any change, in particular if your e-mail or postal address changes.

2.2 Product selection

You can consult the tabs dedicated to the categories of Products on the Site and consult the characteristics of the Products by clicking on the description of a Product on the Site. To add a Product to your basket, you must select the quantity and, where applicable, the size of the Product, before clicking on “Add to Basket”, subject to availability indicated by the words “Product available”, where applicable.

2.3 Product prices

The prices of the Products are shown on each Product sheet on the Site, inclusive of all taxes.

The prices indicated on the Product sheet on the Site do not include delivery costs, which are mentioned when you choose a delivery method.

2.4 Viewing the summary of products added to the basket

Once you have selected the Products, you can view the items in your basket by clicking on “Complete my order” in the top right-hand corner of the Site. The basket summary allows you to add quantities of Products or delete selected Products, then click on “Update basket” or continue shopping by clicking on “Complete my order”.

Consequently, EcomShop reserves the right to refuse any order from a CUSTOMER with whom such a dispute exists.

To continue ordering Products :

    If you do not already have a Customer account, you are invited to create one by clicking on “Create an account”;

    If you already have a Customer account, you will be asked to identify yourself by entering your user name and password and clicking on “Log in”.

2.5 Choice of delivery method and delivery charges

Once you have logged in to your Customer account, you must then fill in the information relating to your billing address, delivery address, delivery method and chosen payment method before checking the summary of your order, and then clicking on “Proceed to the next step”.

    Home delivery

In the case of home delivery, delivery charges are added to the price of the items ordered and are payable exclusively by you.  Delivery is made by [the carrier] in mainland France, Corsica and French overseas departments and territories.

If you are absent at the time of delivery, at the address you have given, a delivery notice will be left in your letterbox: it will then be possible to collect the parcel from a Post Office within 15 days of this notice being left. If the above-mentioned time limit is exceeded, the parcel will be returned to EcomShop.

Unless otherwise indicated on the Site and subject to the availability of the Products, you will receive the Products within a maximum period of 30 working days. In the event of failure to deliver the Products within the period indicated at the time of your order on the Site, you may send formal notice to EcomShop, by registered letter with acknowledgement of receipt, to proceed with delivery within a reasonable additional period. If we fail to deliver within this new period, you may terminate the contract by registered letter with acknowledgement of receipt. The contract will be considered terminated on the date on which we receive this letter, unless we have delivered the Products in the meantime, and the sums you have paid will then be reimbursed to you without interest or compensation at the latest within 30 days of the date on which the contract was terminated.

 2.6 Validating your order

To register your order for Products, you must :

    check the summary of selected Products (quantities, references and prices) ;

    accept these General Terms and Conditions of Sale by ticking the box “I accept the General Terms and Conditions of Sale” after having read them by accessing them via the hypertext link available ;

    read our Privacy Policy.

You must then click on “Order with obligation to pay” before proceeding to the payment of the order.

2.7 Paying for your order

You guarantee that you have all the authorisations required to pay for your order with the bank card used.

You must enter your credit card details and click on “Submit”. Payment of the order validates it.

In the event of purchase and payment on the Site, the Customer’s bank details are deleted once the transaction has been completed and archived for a maximum period of 13 months for the purposes of proof in the event of a dispute relating to the payment. To ensure the security of payments made on the Site, we use the services of a service provider whose payment pages use the TLS protocol and are PCI-DSS certified. PCI-DSS is an international security standard for protecting the confidentiality and integrity of cardholder data (card and transaction data).

2.8 Order confirmation

Once your order has been validated, you will receive an email at the address you provided when creating your Customer account, containing a summary of the order, the delivery date and these GTC.

ARTICLE 3 – RIGHT OF WITHDRAWAL

When you receive a Product, you have the option of exercising your right of withdrawal and returning the Product that does not suit you. You are responsible for these return costs.

3.2 How to exercise the right of withdrawal

If you simply wish to return a Product ordered on the Site, you have a period of 14 (fourteen) clear days from the date of receipt of the Products at your address to withdraw, by sending us the withdrawal form below or a letter of withdrawal (mentioning the information listed in the withdrawal form below):

Where the withdrawal period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

3.3 Return of Products

Once you have informed us of your wish to withdraw, you have 14 days to return the Products to the EcomShop, according to one of the following options:

The Customer shall bear the cost of returning or refunding the Products concerned.

We reserve the right to refuse to exercise the right of withdrawal to any Customer who has returned or restituted one or more items whose value has been depreciated as a result of handling other than that required to establish the nature and characteristics of the Products.

3.4 Refunds in the event of withdrawal

We will refund the full price paid for the Product(s) returned or restituted and the delivery costs (excluding the costs of returning or restituting the item(s)) on the earlier of the following 2 (two) dates: on the date of receipt of the returned Products or on the date on which the Customer provides proof that the Products have been sent or restituted.

The refund will be made by the method of payment you chose when ordering on the Site.

ARTICLE 4 – STOPPING COLD CALLING

When you register on the Site, we collect your telephone number in order to inform you when Products are available in shop or when your order has been dispatched. Your telephone number is not communicated to our partners.

You can oppose telephone canvassing by any professional by registering on the Bloctel opposition list via the link below: https://conso.bloctel.fr/index.php/inscription.php. Registration is free and enables you to refuse to be canvassed by any professional by telephone if you are registered on this list.

ARTICLE 5 – LEGAL GUARANTEES APPLICABLE TO PRODUCTS

The Vendor is liable for defects in the conformity of the Product with the contract under the conditions set out in Article L.217-4 et seq. of the French Consumer Code and for hidden defects in the item sold under the conditions set out in Articles 1641 et seq. of the French Civil Code.

When acting under the legal guarantee of conformity, the consumer :

– has a period of two years from the date of delivery of the property in which to take action;

– may choose between repairing or replacing the good, subject to the cost conditions set out in Article L.217-9 of the French Consumer Code ;

– is exempted from proving the existence of the lack of conformity of the goods during the twenty-four months following delivery of the goods.

The consumer may decide to invoke the warranty against hidden defects in the item sold, as defined in article 1641 of the French Civil Code. In this case, the consumer may choose between rescission of the sale or a reduction in the sale price in accordance with article 1644 of the Civil Code.

ARTICLE 6 – PERSONAL DATA

When you browse the Site or order Products on the Site, we collect personal data about you. This data is used in accordance with our Privacy Policy, which we invite you to read.

ARTICLE 7 – COMPLAINTS AND SETTLEMENT OF DISPUTES

7.1 The GCS are governed by French law.

7.2 In the event of a dispute, you may have recourse free of charge to a conventional mediation procedure.

To use this mediation procedure, you must first send your complaint to EcomShop by registered letter with acknowledgement of receipt. If you do not receive a satisfactory response within one month, you may refer the matter to the ombudsman in accordance with the procedures set out by the ombudsman on his website.

This mediation is optional, confidential and free of charge, with the exception of any legal or expert fees, which you will have to pay yourself.

The dispute cannot be examined by the mediator if :

– you do not justify having previously tried to resolve your dispute directly with EcomShop by means of a written complaint;

– the claim is manifestly unfounded or abusive,

– the dispute has been previously examined or is being examined by another mediator or by a court,

– you submitted your request to the mediator more than one year after your written complaint to EcomShop;

– the dispute does not fall within the mediator’s remit.

If you are not satisfied with the outcome of the mediation or if you do not wish to have recourse to a mediation process, you may, at your choice, bring the matter before the competent courts in the jurisdiction of EcomShop’s registered office or before the competent courts in the jurisdiction of your place of residence.
